To address grid strain and ensure renewable electricity supply,Spain’s Council of Ministers approved an urgent administrative procedure on August 25, 2026, for a draft royal decree. The proposed framework applies to data centers with a capacity of 1 MW or greater, establishing stringent requirements across energy sustainability, water efficiency, grid access, and digital sovereignty.
Renewable Electricity & Additionality
- 80% Renewable Threshold: Data centers must certify that at least 80% of their electricity consumption originates from renewable energy sources. This requirement will remain in effect until renewables exceed 90% of Spain’s total power mix, after which the threshold may be adjusted.
- Electricity Additionality: Contracting existing renewable generation is insufficient. For every 1 MW of new data center power demand, 1 MW of new renewable capacity must be commissioned no more than 18 months prior to the facility’s launch (via on-site generation or long-term PPAs).
- Hourly Matching:During every hour of operation, renewable generation produced within that same hour must cover at least 80% of the facility’s electricity usage. Moving beyond annual matching or origin guarantees, this encourages real-time supply-demand alignment and energy storage adoption.
Grid Access & Compliance Deadlines
Grid connection rights are tied directly to compliance. Non-compliant operators face escalating tariffs and fees, ultimately risking the revocation of grid access.
- Transition Timelines: Facilities currently in the permitting stage have 6 months to comply; projects awaiting grid access tenders have 3 months. Developers may voluntarily surrender grid rights without forfeiting financial guarantees.
Energy, Water & Data Sovereignty
- Dual Category A Rating: Facilities must achieve Category A ratings for both energy and water efficiency under forthcoming EU labeling standards.
- EU Sovereignty Compliance: Facilities must be operated by EU-established entities, maintain operational data within EU borders, and block unauthorized access from third-country authorities. Projects handling public administration or national security data must provide formal guarantees.
Market Impact & Storage Deployment
Spain has already granted over 12 GW of grid access and connection rights to data centers since 2021. The mandate for hourly renewable matching presents both challenges and opportunities for infrastructure developers. Because solar and wind power generation fluctuate throughout the day, operators will need to integrate utility-scale energy storage systems (BESS) or enter sophisticated power purchase agreements (PPAs) to guarantee continuous hourly compliance. Failure to meet these mandatory criteria could result in escalating grid tariffs or even the total revocation of grid connection privileges, reshaping how hyper-scalers plan future infrastructure investments across Europe.
